Hi all, thank you for any help ahead of time... I guess I need support as well as advice. My fiancé has gotten in trouble with the law the majority of his life... unfortunately just when he was starting to do well his past caught up with him and he was arrested. Ok So he was arrested on Oct. 1st for 1st degree burglary and a violation possession (I guess that's what its called) of marijuana. His family hired a private lawyer and on his courtdate in December he managed to lower the case from a B felony to a D... and they dropped the possession charge. So he was sentenced on Jan. 22nd. To 2 years and his final charge was a D felony, attempted burglary and illegal entry. But whenever I call the jail operator to find out where he will be moved to and when they tell me they don't know... He is currently in Nassau County Correctional facility... Does anyone know an estimate about how long it will take for him to be moved, will his visitation start immediately, and would it be stupid to write him at his current location or should I wait until he is moved? I'm in PA and he's incarcerated in NY. I hope that's enough information...

No facility that houses an inmate will EVER tell you when the prisoner will be moved. They cannot for security reasons, so don't ask them. Wait until he either calls you or writes to you so you will have a good address for him to write to. You will have to ask him about the visiting schedule as he will have to put your name down on the visitor's list PRIOR to you going there. No, you don't just "show up" on visiting day and automatically get to see him. So don't go "uninvited" shall we say.

Also, keep in mind that if you are a felon yourself, you will not be able to visit with him in jail. Also, if you have any kind of outstanding warrants, tickets, etc. that the police will happily discover once you're at the facility and you hand over your driver's license as ID as they DO run your name in the computers... DON'T GO THERE. As they will happily detain you until the proper police department or police agency comes to claim you.

Just sit tight. He'll contact you shortly.

They may not actually know when/where he will be moved - his mail (in theory) should follow him... but...

I've never been in trouble with the law, but do you know how long it takes to be put on the call list because I changed my number and wrote him about two weeks ago with the new number but I'm not sure if he's not calling because he can't or because he's ashamed about getting in trouble, also he has me on the visiting list at his current facility would that list follow him over there? Or does he have to put me on a new list? I know I have to wait for him to write me with the exact information but the waiting is hard...

Visiting lists don't follow the inmate. You could try writing to him at old facility as they will forward his mail. It just might take a few extra days to reach him. He may have gotten the wrong idea when he got your old number and the recording said it was disconnected. You should have put on the recording of "the new number is......" Now he probably thinks you've ditched him.

You may not have heard for just about any reason - very possible he didn't get your letter and doesn't have the new number; also he may be ashamed he's in trouble; he might have been transferred to another facility and the mail either hasn't or won't catch up with him. I'd write him again. The NYS system is terribly overcrowded and he may just not have a chance to call you - although he very well might be calling the wrong number.

No, the visiting list will "probably" not follow him. Be sure to mention that when you write him.

I'm sure the waiting is difficult and upsetting but once he's housed permanently things will be better for you.

Depending on the involvement of his Attorney he might be able to tell you something - the Attorney is certainly entitled to know when and here he's moved. Maybe he would pass that along to you.

PS - yes, once he's "permanent" and his paperwork in order visitation will start - should be pretty quick.

Even if the facility KNEW when prisoner would be moved, they cannot disclose this information as it is a breach of security. Otherwise someone may "meet" the transport van or car and help the inmate escape. In most cases, if not all cases, the prisoner transport information does not happen until the actual day of the transfer.

Often they will not know when he is to be moved into a day or two before, He is most likely being held in a county lock up, pending space in a state prison, and depending on your state system, he most likely will go to a state intake facility first, and then to another prison after that.
If you write him, his mail will be forwarded, and yes you should write.

And if they did now, they would not tell you until after he is already moved, that is just done for secuity.

Ok thank you all for your advice... you've all been very helpful, I thought so too that maybe he didn't get my letter. So I'm going to write him right away... (well send the 18 pages I've already written) lol Thank you again.
