Breaking a Lease - Excessive Noise
I reside in NC and have been doing some research on the topic of breaking a lease. Last December, plumbing in my apartment to which I had resided 6 years burst and flooded the apartment. The landlord sent someone in to clean up the water. The carpet began to smell and I had trouble breathing after being inside of the apartment for any length of time. The landlord's response was, "You'll just have to move." Well, it was at Xmas time and I was forced to try and find something quickly since the conditions were getting worse day by day. I didn't do anything to fight back because I knew laws regarding rentals tend to favor the landlord.
Well, the new place I'm living in is terrible. I'm in a lease now. The noise is horrible. I can hear everything from the person above me and nothing fully muffles the sounds. It interrupts my sleep. And to catch up on sleep I've been going out to my car. I was led to believe this was a great place to live. It was supposed to be quiet. I was even told elderly people live here. I have yet to see one elderly person. Since I've lived here, I have also almost been attacked by a large breed dog that was brought over by a visitor to the people upstairs. It chased me to my car and jumped onto the hood growling and barking. I called the police. The office lady has stated that she was not aware of the extreme noise but now understands that it exists. Unfortunately they can not do anything about it because it would require the tenet above me to be moved out. To break the lease, I must pay 2 month's rent. That is very expensive. I have already suffered the expense from the last move. The last experience I "sucked it up" and just left without a fight. But I'm tired of being treated this way. This single woman is just tired. Is there anything I can do to appease them to let me out of the lease without the penalty? Any advice would be greatly appreciated. Thanks for your time. |

Actually, letting you out with only a two month penalty isn't a bad deal at all. If they sued you for the entire balance on your lease, they'd have a very good chance at winning. I can only advise you to shop better in the future. Interview tenants. Interview neighbors. Interview everybody! excon |
