How can we find out if our house is in foreclosure?
About two years ago we moved into a beautiful home owned by our children's grandmother. When we first moved in we were asked to pay 1100.00 a month in rent. About a year later she told us that she was having problems keeping up the mortgage and wanted us to pay an additional 800.00-900.00 more a month. We told her that would not be possible and we would move. She then told us to just pay an additional $300.00 more a month and that would be fine. She also asked us to purchase the home ourselves. We do not feel we are in the posistion to buy a home at this time. So we declined the offer. After paying 1400.00 a month in rent for some time she then told us she was going to sell the home. She told us to stay in the home until she sold it. About 3 months after that she told us she was going to let the house foreclose. About a month after that she told us she was going to sell the home. We don't know what to do. We want to move because we have been told so many different things. We fear that the house is already in foreclose and she just hasn't told us that. Is there any way we can find out if in fact the house is in foreclose. We have no lease. If we moved now would be breaking in laws?

Well foreclosure is a long process, first the person will be in defaut, and normally the bank will go 3 or 4 months without getting paid before they start legal action which will vary by state, in some they have to go to court. But there is really no way you can find out until there is court action,

If you want to move generally in most states when you have no lease you have to give notice equal to the time between when you pay rent. So if you are paying rent monthly you have to give 1 month notice before you move. Check with your local government to make sure but that is generally the case.
