Gave 60 day notice, not sure what's next? TEXAS
On January 9th I turned in my 60 day notice to my complex and paid a reletting fee of $828 due to the fact another city's police dept kicked the door in (Jan 7th)... only misdemeanor charges were filled (Don't understand why still) and to avoid the coming eviction we paid the reletting fee. Well my dumb roommate threw a very small party the 17th and the cops came and arrested him for "disorderly conduct". Now the complex is saying their going to attempt to evict us before the 60 days is up(March 9th). On Friday the 18th I was told by one of the leasing agents I could sign a form releasing myself from the lease and only leaving my roommate on it to avoid the eviction going onto my record. Now apparently someone from corporate is saying we should have never been allowed to pay the reletting fee, I wouldn't be able to get my name off the lease, and that an eviction would be pending. They're going to call us on Monday (Jan 21st) to discuss what's going to happen in more detail...

    My questions are:
    A. Can they evict us before the 60 days is up even though we paid the $828 reletting fee?
    B. Can they refuse to let me take my name off the lease before the eviction is finalized?
    C. we've paid our rent for the rest of this month (January) can they evict us before the end of the month?

Thanks for any answers or helpful info

    1. Yes, they can evcit you,
    2. they do not have to let you take your name off the lease. Actually landlords seldom let you
    3. yes, if hey are evicting for a reason other than rent payment, if they evict for ciminal activities, they can.

What is the process of eviction? (time table) Currently I've been told that tomorrow (monday) we'll be asked to leave and no eviction will be filled. But should I use the fact the rent has been paid for the rest of January as a bargining tool to stay more than 24 hours or 3 days (so I have more time to find a new place and get my out) or just be happy their not filling the eviction and get the hell out of there?

    Thanks again!
