    Separating assets
    Hi, I have a little bit of a dilemma. My ex who left me and our 2 young children, 2 days before xmas, has given me a list of what he would like. In this list he mentions he would like the kitchen table and chairs. This table and chairs was given to us by his parents but when they asked if we wanted it, my ex said we had no room for it. I told them, that I wanted the table and chairs that also came with the buffet and hutch and matching rocking chair. He only wants the table and chairs, I feel I shouldn't have to give it to him since he didn't want it in the first place. This would also leave me without. We are having sort of a hard break up. Not getting along, probably cause he won't talk. That's why were here in the first place. Could someone please help me out, I really don't know what I should do. He also said he could give me 400.00 support a month, which won't even come close to helping pay the huge credit card debt that he has left me with.(aprx.12000.00) I know it's better than nothing but he brings in 2 thousand a month, I think he should pay more, am I right.

    Well first, are they his children? My guess is yes, so you get a order of custody for the children and file for official child support though the court.
    This is a must. They will set the child support according to the state law,
    Most likely more than 400 a month for 2 kids.

    Next were you married, you said ex, but that is also what people call ex boyfriends, if you were married, you file for divorce and in court and mediation you divide up not only the property but also the debts. The court will say who pays what,

    No we weren't married, but lived together for 4.5 years. The children are his, a boy 33 months, and a girl 15 months, the only thing with the credit card debt is all the credit cards were in my name only, but they were at zero, when we got together.
