    Paid 50% of home mortgage titled to my fiance' - now he wants to evict me - is legal?
    My fiance' purchased a home (the title and mortgage are on his name ONLY) and I have been paying 50% of mortgage, upkeeping expenses and home improvements (I have bank statements and receipts) since day 1 - for about 1.5 years.
    He now broke up the engagement, and he is asking me to conribute to 50% of the mortgage and expenses, until we sell the home. He promised to split the profit (if there will be one). If I don't pay, I am afraid he will call the police and kick me out.
    1) Can he do that?
    2) If I leave, can he sue me if I keep the engagement ring, as a partial refund for all the expenses I paid towards his house?
    3) Do I have any legal right to claim something back, for all those improvements to his house I contributed to?
    I am very concern, please I need advise on what to do - I am in Florida

    What sort of written agree do you have on the house?

    Was there an agreement to be paid back?

    Were you also living there ?

    You may have some rights but you need to see an attorney.

    I have been living in the house for 1.7 years and I am still in the house now, but I am literally afraid he will come soon with the police and ask me to leave. I don't have any written agreement, but I have receipts that I paid 50% of all expenses, mortgages and home improvements. He is treatening me to give the ring back. If I keep paying mortgage, and he makes a profit, he said will give me 50% of profit. But if I stop paying the mortgage, he won't give me anything, because my name is not on the title. What should I do?

    Hello strawberry:

    He can't kick you out. If he does call the cops, don't you worry. At the very least, you're a tenant, and you can prove it.

    In fact, I think that's all you are. I don't think you're entitled nor do I think you'll get any equity from the house if there is any. I also don't think you have a claim for the payments you made. They'll probably be considered rent.

    Plus, as a tenant, if you don't continue to pay as he instructed, he can evict you. That'll probably take a month or so, though.

    He might be able to sue you for the engagement ring. If he gave it to you in contemplation of marriage and the marriage didn't happen, he's entitled to it back.

    So, since you've got nothing to gain by staying there, I think you should leave.

    1) The police will not kick you out as long as you can prove you live there. But since he's the owner of the house and since you probably have no lease, he can evict you with only a month's notice.

    2) Whatever you paid will be considered rent. I doubt if you can use the engagement ring as compensation.

    3) If you can prove you helped pay for physical improvements to the house, you may be able to get reimbursed for them. But not for what you paid towards the mortgage.

    Mostly from what your saying its going to depend on where you live. Some states allow you to keep a ring if the other party broke it off. As far as the house goes you might ask him to put in writing your contribution and what percentage of profit from the sale will be.
    If he refuses again check your local laws and examine your rights carefully.
    I know it's a difficult time and don't allow yourself to sink to far get some help not just legal but for yourself too.
