I am currently on misdeameanor probation for 3 years. An incident happened before I was on probation that investigators are going to charge me with. The incident involved checks and possibly a credit card but according to the investigator for now I am only going to be charged with possession of a forged instrument. I have talked with different people and am getting different answers. Some are telling me not to worry because the charge can be dropped lower and they can add onto my probation, some tell me that I can ask my public defender to get the DA to agree to me being on house arrest. I have to turn myself in on Monday coming up. I have dealt with the investigator on several occasions and he is telling me that I will be let go on my own because I am not a flight risk and I have children. Ultmately it is up to the judge but he assures me I will be let go. I do not know who to actually believe and I need someone who is not going to criticize to tell me what to look forward to. Some people are answering saying I deserve this and that. Okay, fine but for the sake of my children I need to know how serious things are at this point. I see my P.O. every two weeks and just saw her last week however she is tranferring to another unit so I will get a new P.O. that I haven't me yet in two weeks. Although police contact is a violation, this investigator said they have ways to work around that. Again, I'm not sure who to believe. Some say he is correct, others don't think so. The only person I have talked with so far that makes sense is my brother who has committed a lot of crimes but he lives in another state and I live in NY. So the laws are different here. If I were you I would ask my attorney what's going on as they can actually charge you all over again on the new charges and NOT just add to your probation. Be sure that you have your children looked after when you report for probation because they can do whatever they want with you when you are in their office. They can keep you for as long as they wish. I have never heard that police contact is a violation! Investigators are generally not looking out for any body and will tell you anything to get you to confess. Speak to your attorney!

You need an attorney , many things can happen. Including jail time. You may get a second probatoin, you may get a fine, you may get jail time,
Since this will be a second offence it is hard to say what a judge may do
