    Child custody rights
    I want to know if my ex-husband has physical custody of one of our kids and I have it for the other child and we share joint legal custody of both children does he have the right to move from where he lives and leave my son behind to live with a friend of his? I told him he can't do that and I have a say in it and he says no I don't... he lives in Texas and I live in Ohio... but our divorce was done in mass... he thinks because he has physical custody of this child that he can do what ever he wants with him and I can't say anything about it... but he isn't understanding that we share legal custody... can you help me with this please... :confused:

    Since you share joint legal custody of both children, he'd need permission from the court to move away with the child that he has physical custody of.

    No he can not, you can refile to have the custody agreement modified for you to have custody of both. Also why or who ever thought spliting up two siblings was a good idea?

    U have to go to the state where it was done first to change anything because other states can't change or modify other states orders you can have it put in the new one that you guys moved and they not make it final and go to the court in the state of your choice and you both have to get permission from each other to move out of state with either child because of the well being o the child is in jeopardy
