    Child abandonment
    My husband is the father of both of my children. He had an affair and we split up about a year ago. He moved to Delaware and we still live in Georgia. He doesn't pay me any child support at all. He promises to send money here and there but never follows through. I'm behind on all of my bills as I was laid off in September and without a job for 5 weeks in which time he still gave no support. What can I do? I can't afford to file for a divorce right now but I REALLY need financial help and I feel it's his responsibility. Anyone know how to file abandonment charges against him or if my situation even applies?

    Make an appointment with the child support enforcement agency in your area. There should be no charge for this. Also if you qualify for public assistance they should also be able to help you go after him.
    Warning a lot of people get angry when they have to start paying and threaten to take the kids. If I were you I would file for custody. I know here in Ohio it is a 50 dolllar filing fee. *edit* maybe this site can help you out.georgia.gov - DHR Office of Child Support Enforcement

    Umm, you can't afford NOT to file for divorce. You should have filed as soon as he moved out. If you had a custody and support agreement would have been in place all this time forcing him to pay support.

    Abandonment charges are not what you want. This is a very misunderstand issue. Abandonment may be GROUNDS for divorce, its not a charge you can apply against someone. Abandonment as a charge is like if someone lease a baby in a dumpster or alone at a home and then walks away.

    Abandonment charges do nothing really, unless you were using them as ground to have his rights terminated and the children adopted.

    You need to file for divorce and child support... start talking to attorneys (many offer free consultations) and many will take payments.

    OK, at this point and time, he does not have to pay anything officially since there appears to be no child custody agreement, you should have filed the day he left, you file for divorce, file for child support and custody of the children, if there is no paperwork, he has full equal custody at this time hisself.

    So get with legal aid and get started.
