    Regarding the lump that thinks he can live here for free.
    I offered for a friend during his xfer from nyc to here that he could stay here. In exchange for staying here while he got his feet on the ground he would pay half the rent, get free utilities, and help with childcare.

    I have financial records showing that he has only paid 200.00 since June (it is now december), and I also have a check that I wrote out to him to help him when he first got here and had no money.

    He also would not even look for a job until recently.. and went from police officer in nyc to pizza delivery driver.

    So, he has a real job now, he's planning on moving out.. and still refuses to pay anything. He's a gaming addict so I threatened to turn the internet off if he didn't pay.. but he couldn't care less. He was supposed to watch the girls the other night and he replied with "this is their dad's job!" Granted there is no way in hell this man will be left alone with my children.

    Basically, I want to take him to small claims court once he moves out for the money he owes me for living here. Its not about the money, it's the fact that he honest to god thinks he can live here for nothing. When I confronted him about it he said he doesn't feel like he owes me any money because I live off my ex-husband. I said umm.. I live off my ex because I'm a single mother, in nursing school, and working part time.. what rights do YOU have to live off him?

    Ugg, I'm very frustrated.

    Hmm - if he lives with you and won't leave you will have to evict him. Small Claims, of course, will work AFTER he leaves, IF he leaves. In my experience you will have one problem regarding proof which is a rental agreement unpaid since June (6 months) - the question then becomes, "Why didn't you kick him out X months ago?" Not saying you won't win but you could get the Judge's lecture.

    I would be more concerned that if he is this irresponsible (his comments, his gaming problem) and your X gets wind of this you have brought someone somewhat unstable into your children's lives... and home. Who watches the children when you are at work and school?

    Interesting that he went from Police Officer to pizza delivery person - does he have "issues"?

    His issues are that he is just very oblivious and selfish, and lazy. My ex-husband and I both knew him when we were married, so he was a mutal friend. The ex thankfully is very supportive of me, and is pretty pissed off about the entire situation. He's biting his tongue about the whole living off me comment.. that really set him off. I mean, it was hard enough for my ex and I to settle on this dollar amount of child support and alimony. I had to really drill it in the ex's head that I was a stay at home mom... I need help getting my life back together. So for the ex to finally accept that, and then have some so-called friend make that comment, and take advantage of both he and I has really put a bad taste in everyone's mouth.

    As for him watching the children I cut that out months ago unless its just a quick trip to the grocery store or something. My ex husband and I have a good set up, and he watches them while I'm at work now. I have decided also after these recent comments that I'm not even going to do a quick trip to the store.

    Also.. as for how long he was here with not paying. I guess my answer is this...
    The first month I kept sending him links to job applications, and information about local police departments. The second month I realized this guy was doing NOTHING, so I put him in my car and drove him to a pizza place and told him to go in and apply for a delivery job until he finds a day job. At this point I'm still not asking for money. So... the third month I start asking for money and I'm getting 20.00 here, and 20.00 there. Now, at this point I had just finished school, got my state certification, I'm waiting for this big job that is going to 5x my income.. but I don't have a pot to piss in. I can hardly keep my electric on at this point.. and the car breaks down. Well, if he was paying me what he owed me I could have fixed it. (which is the ENTIRE reason I allowed him to move in.. To have a little something extra to help me keep my head above water in this whole school and back to work transition). So I figured the hell with it and just started driving his. In order to fix my car I said.. just pay the cable bill every month.. that's all I ask. 120.00 is all I need to keep my head above water until this job comes through. I've received maybe 100.00 from him since I asked for that.

    So... I finally started the new job. However, before I told him to move out I asked him if he was planning on paying the cable bill and that's when he lashed out that he shouldn't have to pay me anything for use of his car and that I live off my ex-husband. That's when I told him to get out... there was no being nice and waiting till after xmas at that point.

    Ahhhh... and the update is...

    My credit cards are missing, police report has been filed, and he's about to be physically removed tomorrow when they come by here. So.. that might help with the small claims court LOL.
