    Real Estate rented apt with Building Violation posted
    I paid a real estate to find me an apartment. The real estate rented the apartment that said the conditions in this apartment are perilous to life. I looked at the apartment and it was redone brand new; which attracted to me. I soon found out when I was living there that were a lot of cockroaches and when I took the landlord, he told me to spray. There was even a mouse in my bed when I came home from work. I resided with a small child of 7 years old. So I couldn't take it and moved out 5 months into my lease. The landlord will not return my security and I always paid my rent on time. Am I entitled to my security back? The landlord was threatening to sue me for his lease money, but in his lease he stated that no roach devices were to be used in trying to rid the insects. Am I due my real estate broker fee because of the unsafe living conditions? Is that against NY state law?

    IF you were warned prior to moving in, that the conditions were perilous to life, you should never have moved in. Also did you spray for roaches and put out mouse traps, people do that if they have pests.

    IT will be up to the judge if you owe him all of the rest of the rent or he owes you the deposit, so you sue him he counters sue you and the judge decides
