    Process for Bankruptcy
    What is the process for bankruptcy? I don't want to lose my home... is bankruptcy expensive?

    Depends on what form of bankruptcy you use.

    The filing fee is about 280 or so, and I know attorneys that do a chapter 7 for 1000 dollars ( and know some that do it for 3000 also)

    You have to do a pre filing credit counseling with an approved company, you list all of your debts, now you will have to still make all of your house payments, they can re-affirm that debt, work out a plan to pay the amount you are behind, So can you afford to make the payments

    You're looking at maybe $1200 in attorney's fees plus filing costs (maybe $300.) You'll need to provide your attorney with all of your debt information. (S)he'll advise you on exactly how to proceed and become your line of communication with your creditors. In short, your attorney will file the motion for bankruptcy with the federal district court for your county of residence, a hearing with a trustee will be scheduled which you and your attorney will attend, the trustee will examine your petition and maybe ask you some questions. Then, assuming the trustee is satisfied that your bankruptcy motion is in order, (s)he'll recommend to the court that it be granted and it will formally take effect when the judge signs off on it.

    Also I have found that all do not offer the first visit free any long. Out of 10 I called this week, only 1/2 offered the first visit free, the others charged a fee that averaged at @ 100 dollars for the first visit.

    I was told because the new laws do not allow as many people to file, and the procedures are harder, there is a fee.
