I have a 4 year old son and I live in Ohio. I am married to a man since 2004 and he is in the military. My husband has raised my son since he was 4 months old. His "biological father" took me to court in 2005 for visitation rights. He was issued rights through the magistrate but since has never tried to see or contact since. He has quit jobs so they cannot take child support from him. Finally after a year they were able to find him at his new job and I began getting support again. He has had several DUI's and I've known him to be a drug user. My husband and I want him to give up his rights so my husband can adopt him but he refuses to. What do I do??

Start asking the state for as much back child support as possible, as soon as possible.

THEN ask him to give up his rights, reminding him that if he gives up his rights and your husband adopts, he doesn't have to pay child support.

I really recommend getting a lawyer, though. A good attorney would know what hoops you'll have to jump through to get this accomplished.

You get an attorney, they will prepare paperwork to get your ex to sign over his rights, if he wants to get out of paying child support, most likely he will.
