    Property lien
    I sold a piece of property to a "friend" and he has failed to pay $18000.00 of it , the payoff date is three years ago.
    Can I place a lien against his property.
    I have a signed promisory note.

    You should be able to record the promissory note with the local town/county/city clerks office. By recording the note you will have a lien on the property and you friend will not be able to sell the property unless you files a release. If you have a mortgage with him, you are better off recording the mortgage - I will still call the secretary of state in you state to confirm, each state may be a little different, but the general principals should all be the same.

    You will have to file a lawsuit against your "friend" and obtain a judgment. Once you obtain a judgment it acts as a lien against the property, and the property cannot be sold or financed without the judgment being paid.
