    Disability vs. Child Support Obligations
    My fiance' had been paying his child support obligations even though he gets social security for his disability and isn't able to work much if any. Approx. 9+ years ago he received his child support checks back with a note stating the case was closed. Just recently when we decided to get married, he received a notice from DHS stating that back-payment is now due, and he must pay his child support as well as a substantial amount that is past due. My question is, how obligated is he to have to pay this amount since he is on social security and by rights the child in question should also be receiving a check? Who will be obligated to pay the back amount? My concern is that we have written documentation showing the case was closed, and payment was returned for at least two months in a row. I don't want this to be a glitch on his credit report, yet I don't feel as though the amount is owed by us. Please help.

    Is child support Court ordered? What does the Court order say? Did he go back into Court to modify it upon being advised the case was closed?

    My concern would be that he was paying past due support, that past due amount was paid in full, the case was closed. Ongoing support was not addressed.
