    What do we do
    Hi myboyfriend has two children from his first marriage,the children are 15 and 13.He has been in and out of jail for non support.So that dose not leave much time spent with the children.They are at the age now where they don't want to see him.He is now paying childsupport and they still don't want to come visit him.His ex wife wants him to sign over his rights and she will end all childsupport,she don't owe anything to the state.She wants him to pay for this and he is willing to do so we just need some advice.We contacted a attorney that wants 750.00 to do it,is this a good deal?Do you have a better way to do things?Or know a cheeper attorney for this case it should be easy she wants this more than he dose.If anyone has any info please email me back thanks.

    Mother wants father to relinquish rights(both agree)
    We are in the same boat as scott but there is a potentially father to adopt the kids.How would we go about doing this?She wants him to relinquish his rights and for her new husband to adopt them.

    Unless the mother has someone to adopt the child in the fathers place, he cannot sign away his rights and get out of paying child support.

    OK, now this is new info to your first thread. It is better to add additional info to your existing thread instead of starting a new one, or I would have answered the first one differently.

    If she is married and the husband is willing to adopt then all should be well. I would not however, agree to pay for everything, because that will include their adoption end. They will need an attorney as well to go through the adoption process.

    Your best bet would to be start calling around to attorneys that offer free consultations. Set appts with several and get the best prices. If everyone is in agreement, it shouldn't be that expensive to do. But I would definitely split the costs.

    It's better if you follow up here rather than through PM...

    She is gaining something in this too (her husband adopting the child) so I would seriously consider talking to her about her covering her own costs.

    But if the father is set about paying for it all... I really can't give you a figure.

    You will just have to talk to different attorneys. You need to inform them that you are paying for BOTH the reliquishing of rights AND the adoption.

    The mother needs to hire an attorney to process the adoption. Terminating his rights is part of the adoption. Let her find the attorney and send him the bill.
