    Are cubicals a hipaa violation?
    I know a physician whom uses cubical dividers for patients who are having test. And in the same area are patients who are waiting. Is this a HIPAA violation? The test that are being performed are ultrasounds and there is not a lot of talking except for the technician doing the test has to talk into the machine. There are also call in's that are overheard in the same room.
    This office is a cardiology office and also has been known to have one pt. behind a divider having what I think is a EKG and another being "worked up" . By this "worked up" I mean weight, BP, and questions about current medications. Everyone around is able to hear this.

    No cubicles are not a violation. Now you may have other concerns about the office and close quarters. Does the HIPAA Privacy Rule require hospitals and doctors' offices to be retrofitted, to provide private rooms, and soundproof walls to avoid any possibility that a conversation is overheard?
