    Account Garnishment
    Hi,

    I just found out that my checking account has been garnished. I did not receive any notice about any garnishment hearing or receive any notice of any legal action pending. How did this happen?

    It cannot be garnished without a court order. I would suggest you ask your bank if they got a court order!

    GO to the bank a get a copy of the garnishment, File MOtin to vacate the garnishment, due to improper service, request a hearing .

    This is freeze the funds from being released.

    What makes you think you would have received any such notice? You should have received notice that you were being sued and that a judgement was awarded. But once the judgement is awarded, there is no requirement to notify you of any attachment orders. Why should they give you advance notice so you can close the account?

    If you were unaware that a judgement had been awarded, then you can get a copy of the order from your bank and file a motion to quash on the grounds of improper service.
