Breaking a Lease in FL
So, perhaps this is a dumb question, but it is one I will pose none the less. My Landlord contacted me the other day to indicate that he wanted to put the property on the market. I will assume that this means he would like to show the property to others. I am not a fan of this idea. I called him and left him a message stating this, but I have not heard back from him. The lease states that he has the right to sell the property and enter for the purposes of showing the property, but it also states that he must have my consent. I will not give this. What are my rights... choices... etc.
I don't know him, as we did everything through a leasing agent. He seems like a nice person; however, I would welcome to the opportunity to end this lease agreement. How insignificant can an item on the lease be to null it? The lease states that he will provide me with a garage remote control- he has never done so. I have been here 4 months now, and still he has not provided me with a copy of the lease. Subsequently, I have not been able to switch the water to my name. So, he is footing the bill for this. Last week, there was a leak in the water main in the front yard. I had to have the neighbor call for service, as I don't have an account. This was a little inconvenient, but I can get over it. But the reality is, my financial situation has changed and ending the lease is in my best interest. I will talk to him and tell him what is going on, but I wanted to know what was legally binding. I don't want to put him under any financial hardships because I want out, but I don't want to end up evicted or in court paying fees because I couldn't pay the rent. Any information that is given is helpful. Thank you. |

If your lease says he needs your consent, don't give it to him. Tell him that if he wants to show the apartment, he needs to let you out of your lease. That said, I don't believe your lease says that. No landlord in his right mind would agree to that. But, in the absence of better information... excon |
