    H1B Taxes, Canada & US income tax complication
    Hi,

    Please help me out with this tax situation.

    1)
    I was employed Mar-Sept 2007 in Toronto, Canada.
    I entered US with H1B starting Oct 2007 (hence less than 183 days for 2007 Calendar year)

    How should I go about doing my taxes, i.e. filing Canada, US or both? What are my options? Which is the best?


    2) I have a huge amount of Canadian Education credit (~60000) due to international tuition from 2001-2006. Is there a way to apply them on my US taxes as a deduction?
    Will this factor change decision made in 1) ?

    You will need to file taxes in BOTH countries.

    I cannot say how to file the Canadian tax return, but you will file Form 1040NR or 1040NR-EZ for the U.S. return. This assumes you are SINGLE. If you are married, let me know and I will give you another option.

    You CANNOT claim any education credit or deduction filing Form 1040NR or 1040NR-EZ.
