    I want to sue a school
    Hi,

    I want to know if I have a case or not. My son was recently as I would put it assaulted by one of his teachers at school. This case is still under investigation but I want to know if I could sue the school or teacher and what are the limitations about this. Also we live in Missouri.

    I would consult an attorney, But I would wait to see the results of the investigation before taking legal action.

    It doesn't matter the results of the investigation since a civil suit has a different standard than a criminal one.

    There's a lot of factors that come into play here. What exactly was the nature of the assault and under what conditions did it occur? Was the teacher breaking up a fight or defending him/herself or another member of the school community? Was it a disciplinary episode? What does Missouri law say regarding corporal punishment in the schools? How serious were your son's actual injuries and what real losses were sustained by your family as a result? These and other factors will come into play in determining whether you have a civil case. The teacher may have sanctions coming to him/her as a result of the pending investigation, which could range anywhere from a reprimand to job loss and essential "blackball" from the teaching profession. Again, there are many factors that come into play.

    As s cianci noted, I would wait for the investigation, and you did not say what type of assult you are discussing. But it is rare for a teacher just to attack a student, So if you begin legal action on a law suit, it is very possible if the investigation does not prove your side, the teacher or school as a counter measure or as a fight back, will counter sue you and your son.
