Felony probation violations
My boyfriend is on probation for a felony and he just got picked up for driving on a suspended license. I understand this is a misdemeanor, but is it a probation violation ?

Most likely not, esp if driving or having the license suspended was not part of the reason they are on probation.
But he needs to call and notify his PO "RIGHT" away, the worst thing is to let the PO see it on a computer report.
IS it a probation violation, yes of course it is, any criminal act and other acts not allowed are all reasons for vioation of probation, but it is the POs choice as to what issues they will use to vioate the probation,
He needs to explain this to his PO

Hello Bessie:
When I was on probation, I was required to obey all laws. If I didn't I would be violated. Driving on a suspended license is breaking a law.
As the Padre says, if he's upfront with his PO, he probably won't be sanctioned. However, if the PO finds out himself, watch out!

The same thing recently happened to my husband. He told his PO immediately and asked him if he would get violated. His PO said he won't do that. When he went to court he asked a lawyer there for some advise and he told my husband that right now it's a 511 which is a misdemeanor and if it stays like that his PO doesn't have a choice, he will have to violate him (so the lawyer says). But if he could get it droped down to a 509,(which is what landed up happening) which is just a traffic violation then he'll be fine.

Since it is a crime, albeit a misdemeanor, it would certainly be considered a probation violation.
