    What contitues Disertion of spouse in child custody?
    We Live in S. Florida. My son will soon be seeking a divorce and wants custody of his two boys 11 and 13. Things at home are getting intolerable and he is losing weight. He is in fact the sole provider for the family both monitarily and physically. She does not work and we are quite sure she is on Cocain, and positive that she is addicted to pain killers. My son has lost a lot of weight in the past few months, and is having concentration problems at work due to the home situation. I want him to leave the home for a week or two and come and stay with his Dad and I so that he can get some rest (she is up all night and sleeps during the day when he is at work) He needs a few good meals and a chance to clear his head. We would be willing for him to bring the kids with him as he is the one caring for them. His lawyer has told him not to leave the house as this would consitute dissertion. Would a few days away be so bad?? I actually think that she might agree to a cooling off period for both of them. I fear that he is close to a nervous break down.

    I hear the mom talking and I would be the same BUT lawyer said no because it would consitute disertion and I am afraid your son has to abide by that decision otherwise he would be jeopardizing SO MUCH.

    Your son will just have to come up with hidden sources of strength in a very uncomfortable situation. Why can't you visit him and initiate some TLC; stay in a motel and visit if you don't feel you would like to stay in the house. Your presence would be beneficial I would assume.
