What I'm trying to find out is if someone is on probation and they owe over $6,000 and they will be off probation in Feb. but haven't been able to pay on their fine due to the lack of money. This person also did time in jail as well and wasn't able to pay on this fine. Can they file a hardship with the judge to get this dropped. They have been on probation since they were 17 yrs old and we are trying to find some answers. This person has been told that if this fine isn't paid that in Feb they will go back before the judge and could possible go back to jail and they now have a family, a job and has changed their life. They were also told that the probation officer could FIFA them as well.

I would say that if the person has regularly paid on the original fine and has a stable income that your claim may be taken. However, if there has not been payments and things are still very unstable then the person would have a lot to prove that it is now a hardship. Even paying $5 a month most any one can afford and that goes a long way to prove the person intent on reducing this fine.

This person's probation officer won't take anything less than what is owed. This person has 5 kids and pays $375 a month for child support, $200.00 a month for rent, $500.00 a month for utilities, has to spend $200.00 a month for food, $60.00 a month on insurance for a vehicle and only makes $700.00 every 2 weeks, has a lean on their home because they can't pay their property taxes, pays $300.00 a month in gas to get back and forth to work. This person has a wife and a mother who has cancer. So $5.00 is very had to give to pay on probation. Also has a child that is on probation that is a minor, pays for field trips for their younger children plus filed trip shirts as well as having to buy school clothes, shoes and school supplies.
So can you tell what other option's are there?

Clearly a hardship does exist. At this point it is a matter of proving it to the P.O. and/or the Judge. The person has to remember that a crime has been committed and restitution has been ordered to help re-pay the victim. So the person needs to acknowledge that and state that they are willing to do whatever is necessary to uphold the court order and/or the probation terms. Remember the system is not very understanding concerning this because most probationers don't even make attempts to pay restitution or fines. This person may have a hardship but the victim may also. If this person can show just like you explained that based on this money coming in they are paying or supporting XYZ than they will be better off.
Has the person approached the P.O. or collections department about a payment plan? How long have they been on probation and how much have they paid so far?

This person has been on probation since they were 17 yrs old and they are now 31 yrs old. They were in a vehicle with a relative and they got pulled over and the vehicle they were in this person's family member stole before they picked them up and this person didn't know that fact. The judge made an example out of this person. They have already paid $4000.00 on this fine. This person was also sent to the detention center for 24 months as well as for this matter and this person wasn't even involved with the vehicle being stolen. The relative had a set of keys for the vehicle.
Yes they talked to the probation officer and the least amount that they will take for this is what is due on the fine that needs to be paid every month when this person reports which is $120.00 a month.

This sounds unreal... 14 years for just being in a stolen motor vehicle and serving two years in detention, then owing restitution in the amount if 11K
I don't know what state this is in or what else is going on but it all is completely out of whack in my opinion.
