No notice. While fighting for my health
When I moved to NYC to go school, I charged my tuition on 4 cc's. I had expected my financial aid to kick in, which would have allowed me to pay off the cards right away. However, I left the school before it did. This left me about $15,000 in debt. I was making the payments until I became extremely ill. I was unable to work for almost a year while I was under going treatment. I had to apply to social services for medicaid and benefits just to survive. During this time I responded to the creditors notices. I informed them as to why the payments had stopped and pleaded for some slack. I was denied. One of them received a judgement against me and froze my single digit bank account. I never received a summons or notice of any kind regarding the court date/ judgement. I had no idea until months later. I was able to return to work but unable to cash my paycheck. Can they do this with out serving me papers? It's been way over 30 days and I can't afford a lawyer. I'm living paycheck to paycheck right now as it is. Is there anything I can do myself? I have been advised not to make payments, since it's been close to 2 years already and I can't afford it anyway. I've also been advised to file chapter 3 and regarding filing chapter 3 is the worst thing possible. I am so confused and pretty freaked out. I would appreciate any opinions on how to handle this without causing myself any more damage. I don't make enough money to pay the min. balance on 4 cards. I was set back a whole year in my life and working 3 jobs is not an option at this point.

I can't help you with the legal part... but from the experience I had with my credit... filing chapter 3 wouldn't be the end of the world. I paid mine off, and have been told that my credit would "look" better if I had filed chapter 3. It goes away as quick as the bad posts on your credit report do. In other words, because I tried to do the right thing and pay mine... ppl who filed bankruptcy would get approved for something before I would. Weigh you options... make payment arrangements, file bankruptcy or go to a credit repair company
