    Can I file a lawsuit against AIMCO?
    My lease with Aimco Property- Harbor Town Jacaranda in Plantation ended on August 16, 2007.
    First error on their part- they overcharged rent for the entire month of August on my credit card and still have not issued me refund for that. Since the lease terminated on the 16th of August, they were only supposed to charge me rent until the 16th (half the month).
    Second error- They have withheld my security deposit of $ 500 for which I have not heard anything as to if I will receive it or the written notice as per the common law for them to impose claim on it.
    In summary, Aimco clearly owes me money for the overcharged rent and the security deposit - I'm sick and tired of calling, leaving messages, writing to their management staff and corporate office and still this issue is pending.

    What can I do now? Can I litigate this matter in court??

    Yes. Sue 'em in small claims court. It's quick, cheap and easy.

    Let me get this straight. You had a lease that expired on 8/16/07, yet you paid rental on a calendar month basis? Or did you terminate a month to month lease on 8/16? If you terminated the lease (not that it expired) how much notice did you give?

    Did you do a walk through when you vacated? Did you get anything signed as to the condition of the unit?
