    Evicting my exboyfriend from my home which I own.
    I live in the state of NJ and own my home. My boyfriend moved in in November 2006. I told him I was breaking up with him in May. I have asked him to leave numerous times and he will not do so. He does not want the relationship to end. I have repeatedly told him it is over and we will not be getting back together. He does not pay rent per say, he does buy all the groceries and pay for the security system. He has the financial capability to move out but will not do so. I have even offered to pay for all his moving expenses.

    What are his rights? Does he have the right to stay here even though the relationship is over and he does not own the home. He also owns a home, but is leasing it until Feb.2008, he said he would move out then. Do I really have to wait till then or can I take legal action? However, when he moved in, he offered for us to live in his house and rent mine but I said I'd rather live in mine so would that have any barring if we went to court?

    He would probably be considered a tenant so you would have to institute formal eviction proceedings.

    Your BF has established residency and must be treated like a tenant. Send him a formal notice by certfied mail that he must leave in 30 days. NJ may have addition requirements to evict so do some legal surfing for your state. You need to evict him. Start here Guidelines for New Jersey Residential Eviction

    Give him notice in writing that you want him to vacate. If he doesn't, then go to the courthouse and file for an eviction. Maybe you will be lucky and when you give him a formal letter to vacate, he will get the hint and go.
