    TPR and Adoption by Step-father
    After years of apathy, my son's father has recently agreed to relinquish his parental rights. 6 years ago, we agreed to "Joint Legal Custody" and visitation (which he has seldom exercised). His name appears on the birth certificate, and much to my chagrin, appears at the end of my son's name too. He has NEVER paid child support, and I am not worried about collecting it at this point. I have remarried, and would like to know how to accomplish the following per our recent agreement:

    -Relinquishment of biological father's rights (voluntarily)
    -Adoption of my son by my husband
    -Change of my son's last name to our last name


    We live in (Loudoun County) Virginia, and I'm not sure what forms to file to accomplish this. Will a notarized statement from my son's father suffice, or must we file a specific form with the court? If so, which form would I have to file? Pleae advise.

    No, it has to be filed though the court, it is very specific, you really need an attorney. The paper work is not only giving up his rights but giving permission for the adoption also. This is filed along with the motion for the adoption. The adoption will change the last name.

    As Chuck said you are better off engaging an atty to file the paperwork correctly for you.
