    Termination of parental rights
    My fiancée was just notified that he may be the father of a 10 year old child he had no knowledge existed. The mother and child live in Georgia and we live in NY. He received a summons to appear in a NY court for a paternity test and support. He has no desire to have another child and feels jilted because this is so sudden. He is considering requesting to terminate his parntal rights. What are his chances of being successful at this and what if any obligations would he have toward this child?

    Terminating parental rights has absolutely nothing to do with terminating parental responsibility.

    Terminating rights, unless the kid's mom has someone lined up to adopt, essentially means that he has no say in how his child support money is spent. End of story.

    My advice is that he get to know his child, and pray that they don't take him too hard for back support.

    I recently took my ex-boyfriend to court for more child support because he is not paying that much.He told me he is going to Give up his parental rights.Can he just give up his rights because he does not want to pay more money?

    When he takes the test and they prove that the child is his he will have to pay for that child. It really doesn't matter if he doesn't want the child or not he will still have to pay if the child is his. But he really should get to know this child and be a father. And who knows he might be happy that he did. And I hope they do not go as far back as 10 years with his child support some states do that.

    He is responsible for the child (if the paternity test shows that it is his). The courts will not terminate his parental rights... period.

    The only way his rights can be terminated is if the mother is wanting it as well, and if there is someone willing to adopt the child in his place.

    He will be financially responsible for the child, if he wishes not to exercise his vistation rights that's his choice... but he will not have a choice as far as child support is concerned.
