Hi,

I am really scared to losing my daughter. I really need a good lawyer for child custody but I can't afford to hire anyone. If anyone know really good lawyer who can get legal aid fund and if there is more cost I can pay off every fortnight?
I have already applied for legal aid. But my lawyer looks like have no experience at all. When my ex threated her she was panic. So I do not know she can win at the family court.

We had a domestic violence order last year. It is cross order because I hit him back. After the that I left him. He begged me to come back. I told him I would give him one more chance. I was so stupid. He broken his promise for the first day I came back to him.
However I stayed with him and he keeps abused me. He blamed me for everything. He even threatened me using my daughter as a tool. He knows how much I care about my daughter. So I left him this March. After I left him he asked me to see my daughter. He even wrote written agreement. He would not talk to me if I do not want to. But he abused me the first day I visited him with my daughter. Stupid me I kept gone to his place to show him my daughter. My last visit he totally lost it. He tried to kick and hit me. He even threatened me if I ever involved police he would snap my neck and my daugher's neck.
Since the last visit I changed my phone number so he couldn't contact me. And I asked regal advise. My lawyer advised me to use contact centre. But they said to me it looked very serious so they would not accept it. So we went to a mediation. I offered him 2 days a week using contact centre(drop change). He did not agree. After that he rang my lawyer told her he wanted it. But lawyer told me not to use drop change because he can take my daughter away from me. So I offered him he can see my daughter on supervisor contact. He refused to use it.

Now he is threatening my sister. If I file the family court he will steal my daughter and runs away from me. Also he threatening me he will find me and kill me.

At the moment I do not know what to do.
Is there any one can help me...
I am really desperated. I do not have any family in Australia. I am battling alone. I am scared.

Hello, I am not familiar with Aussie law, I live in America... A couple of quick questions for you. Is this your ex-husband or ex-boyfriend and is his name on your child's birth certificate? Does he kow where you live? A word to the wise... do not take your daughter to see him, he has already threatened you and the law could turn on you if anything ever happened to your daughter by seeing him... the law could nab you for neglect and child endangerment because you knowingly put your daughter into that situation. Proceed with caution! Get back to me with the questions.

Thank you for your answer. Yes, his name is on my daughter's birth ccertificate. And He doesn't know where I live. My lawyer from regal aid email me she thought we'd better try full custody of my child and only supervisor contact. When I read this email from her I felt bit better. Sorry I did not know this site is American site. I just search from Google.
Now I just hope everything goes by the law...

I am familiar with abusive men, they like to theaten women and those weaker than thierself, Now of course some do act on their threats but in general 99 percent merely threaten and try to scare and end up crying when they lose in court.

You go and file what you have to file in court.

Hello, It's not an American site... it's for everyone. I just wanted to help you if I could, I just wasn't familiar with your law and wouldn't want to stir you in the wrong direction. It is a good thing; however, that he doesn't know where you live... please, KEEP IT THAT WAY! And, don't conduct any more visits with him unless it is supervised... that's the best thing for you and your daughter. Use your law to it's complete and utter capacity. You have to stay strong! You and your daughter are in my thoughts... I have been in your shoes and I have faith that everything will be OK. :-)

As Reblin said, this is not a specifially American site. We have members from all over the world. But some of us may not know specific laws from your area.

It appears your atty is doing the right thing. You might also look for support groups for battered women, they may be able to help you as well.
