    Whose fault is this car crash?
    Car A is traveling north. He indicates to turn right into a driveway, and waits next to the centre line for oncoming traffic to clear. Car B traveling south indicates left, and slows to turn. Car A assumes that Car B is also turning into the same driveway, and according to NZ law would have to give way to him. Car A starts to complete the turn into the driveway. But Car B isn’t turning into the driveway, he’s going past the driveway to park on the side of the road. If Car A hits Car B, whose fault is it?:confused:

    Car A has turned into oncoming traffic so I would say it is his fault. Car B driver's signaling may have been a little poor but I can't see how he could be to blame.

    And you say Car A has hit Car B. Not that Car B hit Car A. This would also suggest to me that Car A was at fault.

    Its hard to tell though. Were the police called?

    It didn't happen - I'm just wondering who would be at fault if it did. My local supermarket has changed its entrance and I see this situation happening every day, so I thought I'd find out who would be at fault. I thought probably Car A, but I think Car B has caused the problem.

    Which driving laws are we talking about US or UK?

    EDIT - sorry, saw the NZ the second time through.

    You should never assume a driver is going to do anything. Always wait until you can clear safely. (that's what was taught in my CDL class, anyway)

    Car A would be at fault for failure to yield to car B. Had A yielded properly, then A's misunderstanding of B's intentions (i.e. A's belief that B was turning into the same driveway as A) would not be an issue. A should have yielded until B completed his/her turn or was out of the path of A.

    Car A incroached the other cars lane of travel. Therefore, I would say car A is at fault.
