Theft under 5000
Reposted under different name due to advice from another.
Ok this is a story:
3 guys were drinking at a bar, they became extremely intoxicated and thought it would be funny to take this guitar against the wall, as a prank. Though they had the mind set to take it, they didn't look it at stealing. In the morning they planned to take it back to that bar.
So 1 guy blocks, the other stays behind and the role which I am playing takes the guitar. The person under the roll of taking the guitar ran and hid it and went back to hang out with his friends and drink, on the way home alter that night. They took the guitar from its hidning place and intended to bring it to his friends house so they could bring it back the next day.
But sadly they ran into some guys who took it and smashed it. The cops call 1 of the guys a month later, and that guy gave him the guy who took the guitars name. So the guy who took it was called in, they said he was a suspect so he told him that he had nbothing to do with it at first, then he said he did see them. Nervousness is a killer.
So 2 months pass and he gets a call saying that he needs to come in and talk cause they have new information, when he gets there they say there might be an eye witness so he has to get his picture taken. And he shows the person an MSN conversation history he had between the first guy who was called. Where in it, the person is feeling terrible and explains what happens in depth.
The cop says he has a week to confess or they will get a warrant for his computer and look at his history. etc.
This 18 year old canadians parents do not know anything about it.
So what am is he looking at here? Any ideas?
( note the guitar was like $2000)
To me it seems like this guys life is going to be over, though he had no priors. He feels as if he has screwed himself over.

What it looks like to to me is he will have to make restitution. If he does, he will probably get off with probation.

Anyone else know anything else which would be able to help him.
Can you answer if you know the following, what will happen to him. Worst case, best case, and most possible case. And what will go about if he confesses oir doesn't confess.
And what is most wise for him to do in this situation.
Sorry for bumping, but this is extremely hard for him, and is eating away at his soul. And he thinks his life is ruined etc. Lots of things are playing through his head, and never has so many tears flowed.

Most wise is to get an attorney. And borrow the money to reimbursement the owner for the guitar.

So what do you think is his best option? Should he confess? Or hope that a conversation over an internet chat wwont hold up in court.

Ok, I am up on US laws and specificly GA and the area I am now in.
But in general
1. Don't confess ever without an talking to an attorney first. If they already had enough info to arrest you, they would have, If they had enough info for a warrant they would have a warrant for the evidence,
So any threats made at this point are fake trying to get a confession.
2. The three guys need to pawn or sell something and pay this person back for their guitar, A guitar is special, it is often like a family member, my wife being a musician she has hers hand made to her size and shape, and one that is a 2000 would have been speical to this person.
So you need to get everyone to pay up their share of the money and pay this person, and you should not say a word, not talk to anyone before you talk to an attorney
If the IP addresses can be confirmed then it would hold up in court.
