    Month to Month Rental Aggrement
    Hi,

    In March 2007 my ex husband and I rented a cottage on a month to month lease. After about a month I found out he had been using drugs and when I confronted him he basically kicked me out of the house. At this point I called the landlord and explained the situation. At first I did not want my name taken off the lease because I had money tied up in the agreement and I was not sure what was going to happen. About a week later I changed my mind and I wanted to be done with everything so I called the landlord again to find out how I could get my name off the lease because I know my ex husband is not very responsible and I did not want to be responsible for any of his debts. When I called the landlord she was ignoring my call. I called her three or four times and left messages on her home and cell phone and still no response. I then blocked my number and she picked up the phone. She was surprised it was me and what very hesitant to talk. She explained that she didn't want to be in the middle of any problems with my ex husband & I and that she heard I was living in another home (which was true I was kicked out) and that her and her husband didn't care who was living in the cottage as long as the rent was being paid. When I let her know I wanted to be taken off the lease she explained that I had to wait until he paid rent for the next month and then I could be taken off. She was supposed to call me as soon as this was taken care of. I waited for another couple of weeks and I tried calling and again I did not get a phone call back. I then asked my ex-husband why she was not calling me back and he said I was taken off the lease and there was no need for them to call me. At this point I was receiving no return call so I had no reason to believe otherwise.

    Three months have now passed and last week I receive a text message from my ex husband with a picture of a 30 day notice sent by an attorney and I was very shocked to see my name on it along with his. My ex husband said he came home from work and the notice was left on the door (is this even a proper way to serve a 30 day notice?) I then called the landlord and she let me know that my name was never taken off the lease and my ex-husband owes them about $2500. She said they had to get an attorney but they were hoping to settle in a better way with him but because my name was on the original lease he signed they had to give my name too. She said if he didn't pay them what is owed then they would have to sue us both. You can imagine I am very upset about this and I don't think its fair I am being involved. If all this money was owed and if my name was still on the lease how come I was never contacted before? They knew I was not living there and had nothing to do with him but in the end If he doesn't pay I have to pay the consequences as well. I guess my question is what are my rights? Can they still hold me responsible when they would have no communication with me before?

    Sorry to tell you, but you blew it. Since this was a month to month lease, you could have given written notice, sent certified to the landlord that you were moving out and ending your involvement. After 30 days. You didn't do that so you remained on the lease and responsible for it.
