California law on property taxes and leases
Ok here goesI live in California, on 20 acres, the property belongs to my husband nieces and nephew. We have lived here for about 7 years now.:)
Now when we moved here the property was getting ready to go into forecloser, we paid just enough to keep the wolves off our door step. For non payment of property taxes.
Well then came the notice that the property taxes were due it it would for into a lien sale
So I made up a lease. The lease states that as long as we maintain the property, and the property taxes, we had full control of property for 99 years. We took the lease to his niece
And she signed it and both myself and my husband signed it. I gave her a copy and of course I kept the original.
So having that done, we went to the tax office and paid up all the back taxes which was just a little over $6000.00. So that of course took it out of lien sale.
Now here is the kicker, his niece came over today with a 30 day eviction notice,
Saying the property is in escrow and escrow will close in 45 days. Can she legally do this
And what might be my alternatives with this matter be.

Interesting case. From what I understand, if a house is sold that is being rented by someone with a lease, the new owner needs to honor the lease. I'm pretty sure that no one is going to buy a property with a 99-year lease! On the other hand, if they have let the property go to foreclosure, the lease is terminated.

Other people who know more will be able to give better advice than I can.
