    Landlord/Tenant month2month lease
    My husband and I rent an apartment from his aunt there's a month to month lease that has only his name on it because he is the 1 that pays the rent his aunt told me she wants me out in a week can she legally do this even though we are married? I live in NY State

    No. Even though you are not on the lease if you are legally married she can't just force one of you out. But she can terminate the agreement and force you both out.

    That sounds kind of silly of her. You are husband and wife and even though he has name on the lease and pays the rent you are entitled to stay with him legally. What is her reason for kicking you out, is she confused about the arrangement, or she thinks that he is only entitled to live there. I think you both better sit down and have a talk with her and if need be get your name on the lease too if that is what it takes to convince her you are entitled too.
