I was just wondering if is it legal or illefal for a 16 and 21 year old to date
If not, are they're restrictions on what your aloud to do

Its not illegal to date, but it may be illegal to have sex.

However, there is a moral issue here. A 21 yr old dating a 16 yr old would be very suspicious. There is usually too big a gulf in their worlds at this time.

In the US and I think it's the same in Canada you can date at any age but you can't do anything sexual or improper. In other words because one person is of age they would be responsible for anything the 16 year old did. It's not always just sex it can be drinking or drugs. It can be staying out late and not doing as the 16 year olds parents ask.

If your going to date you need to be honest with the 16 year olds parents and if they agree great.

Im not saying there is anything going on at this point but friendship but most of the time if a 21 year old wants to be with a 16 year old the 21 year old wants something more then friendship. Face it the two can't have much in common due to the way people treat a 21 year old compared to a 16 year old. The 16 year old can't do the things the 21 year old can and the 21 year old wouldn't want to do what the 16 year old can. Later in life the 5 years isn't as big a problem but at this age it's a world of difference.

The body is adult but not the mind and that the real focus her mind. Or visa versa He was playing with gi jane and you were in high school.

First, considering that the OP's name is alli1991, I would suspect that she is the 16 year old. Second, Its NOT illegal to date. There are no laws anywhere to my knowledge, that put limits on dating ages. The laws all refer to sexual activity.

The age of consent is 18in Most states, if you are not planning to have sex the big problem is out of the way, bottom line, it is a misdomeanor to have sex if you are less than 3 years older however if you are more then more severe penalties apply.
PENAL CODE SECTION 261-269
261.5. (a) Unlawful sexual intercourse is an act of sexual intercourse accomplished with a person who is not the spouse of the perpetrator, if the person is a minor.
For the purposes of this section, a "minor" is a person under the age of 18 years and an "adult" is a person who is at least 18 years of age.
(b) Any person who engages in an act of unlawful sexual intercourse with a minor who is not more than three years older or three years younger than the perpetrator, is guilty of a misdemeanor.
(c) Any person who engages in an act of unlawful sexual intercourse with a minor who is more than three years younger than the perpetrator is guilty of either a misdemeanor or a felony, and shall be punished by imprisonment in a county jail not exceeding one year, or by imprisonment in the state prison.

In prosecutions under Section 261, 262, 286, 288a, or 289, in which consent is at issue, "consent" shall be defined to mean positive cooperation in act or attitude pursuant to an exercise of free will. A current or previous dating or marital relationship shall not be sufficient to constitute consent where consent is at issue in a prosecution under Section 261, 262, 286, 288a, or 289.

What state code did you draw that from? Unfortunately the age of consent is NOT 18 in most states. It varies from 14 - 18, Also some states do have an age difference qualifier but not all.

In Oklahoma and Indiana ( lived in both) The AOC is 16. That goes for numerous other states as well. I do have to agree with ScottGem.

Is it legal? To date yes.
To have sex, depends on the AOC in that state.
Not too sure about Cananda.
I'd be wary of a 21 year old though. Date, have fun, but don't push it too hard.
The 21 yr. old may not have the same interests as yourself and that usually leads to disaster.
Not always but 99,9% of the time it does. I'm not saying no don't date him, but be careful.
It IS legal to date a 21 yr. old though.
