    Looney Landlord
    My landlord, of the past 10 months, has been NOTHING but problems. Rent is due on the 1 st, and he's here 5 - 8 days prior. If I don't have it to him, on or before the 1 st, he get;s very verbally threatening.
    This month, I had to lay out some money, to have the air conditioning unit in this house that I'm renting repaired. Enduring the past 6 weeks of 90 + temps. in the house, and 95 + humidity, just got too be unbearable. Especially for my 8 year old daughters asthma. Because of the down payment of the air conditioning repairs, I was able to hand over the rent check, until the 3 rd. When I tied to hand over the rent, he refused, because it was considered too late, as far as he was concerned, and told me had had taken legal action earlier, with the Sherriff's Department, who'd be coming to the house, the following morning, to demand payment of the rent.

    My lease agreement, clearly states, rent is due, on the 1 st of each month, but no later than midnight, on the 3 rd. Living in the State of Nevada for nearly 17 years, I assumed that was a standard, 2 - 5 day grace period.

    Hold 2 $ 3,000.00 security deposit, which I believe is no linger in existence, I am asking that the interest be surrenered, at the end of my years lease, as has been done before, through other leasing agents.



    Please advise me, as to how to handle this unconventionally, innappropriate, slum lord !

    I could tell you to fight him. I could tell you a lot of stuff to do (and I will in a moment), but you're not going to change him. If it were me, I'd move.

    Having said that, I certainly wouldn't go with my tail between my legs. Not accepting your rent gives you an opportunity to leave. Did you break the lease?? Technically, you did. Can you be held to the lease for the balance of its term?? I don't think so.

    However, in order for you not to fall victim again, you're going to have to change up. Instead of lying down, you're going to have STAND UP! Your letter to us is a good start.

    Part of the reason I know you are intimidated by him was revealed by how you handled the air conditioner problem. YOU took it upon yourself, instead of dumping the problem where it belonged - at HIS doorstep.

    He didn't take your rent, so that means he wants you out. Ok. Write him a letter confirming those arrangements and let him know that you'll be out by the 1st. In your letter arrange for a time to meet for a final walkthrough. If he doesn't show up (and I doubt he will), take plenty of pictures.

    I didn't look up the exact time limits in your state landlord tenant law, but he probably has 14 days in which to return your deposit less any monies he spent on damages, and a receipt for those repairs. If that check doesn't make an appearance, sue him in small claims court.

    IF you plan to stay, then I have no advice for you.

    I would get a copy of the lease, highlight all the points where he is violating it, send him a copy. And demand that he obey it.

    Personally I would move at the end of the lease, a nut case landlord is not going to change
