    She takes house of market
    Ive curretnly left my wife after 26yrs of marriage. I pay the mortgage although her name on deeds.. She won't sell and Im in digs I can't pay for both what are my legal rights to share 50/50?:)

    You need to negotiate this as part of the separation/divorce agreement.

    Did you just leave or file for separation/divorce? Is the mortgage loan in your name solely or both names or exclusively hers? If she can prove you "abandoned" her, you may be in trouble. Check your local court and file the proper separation/divorce papers ( contested or uncontested). 50/50 only applies in community property states, not equitable share states. Check the labeling of your state in this matter. Seek legal advice asap. Many courts have free law help centers if you are strapped for money. Good luck.
