    Settlement with landlord
    Alabama
    I have a dispute with former landlord who holds me accountable for some money. I agreed with some of the charges and looks like the landlord is willing to accept what I offer if I pay it quick. I know that there is supposed to be some sort of settlement agreement or so, just to make sure he is not going to ask for more in the future. Is there any sample of such agreement available? ( I couldn't find it online). Or what should be written in that agreement? I want to send this signed agreement to landlord asking to send it back to me with signature and then I'll send a money order... Any thoughts on how to settle it right? (mediation is not an option since I live thousands miles away from where landlord resides).

    I would imagine if you were renting - there would not really be a settlement agreement. He could send you a "final" bill - showing the amount agreed upon with his signature. You make a copy and then send him the $ with the words Paid in Full on the check.

    Simple:

    I, <insert name of landlord> accept this payment of <enter amount> as payment in full of all monies owed as a result of <insert your name> vacating the premises at <insert address> on <insert date of moveout>.

    I release <insert your name> of any further obligation as a result of his rental of <insert address>.

    Both of you sign it.

    Is there any way I can add a note on a money order or a check which would state that by cashing this check landlord accept this amount if full and release me from any further obligation.. Cause otherwise its not safe for me to mail such an agreement with a check cause the landlord may cash the check but not sign an agreement...


    I can send a letter to a landlord where I include this

    Write "accord and satisfaction" on the check. It may help but it doesn't always work. It would help if you have anything in writing (or email) showing that you and the landlord have been negotiating the issue. If you could show a judge the letters or emails along with the fact that the landlord cashed a check stating accord and satisfaction then you'd be in a much better position.
