    Marital Debt
    My soon to be husband, has been divorced for 4.5 years, as of this week his ex wife is coming after him for credit card bills in her name that were used when they were married. Is he responsible? Is there a time table that this stuff should have been taken care of?

    If he had a card (from her credit card company) in his name (at times spouses share cards and each is in his/her own name) then he is l/2 responsble unless he can prove he didn't use her card (it is a lame one but still a technicality). Where I live we are supposed to keep records for six years. My husband has every receipt he ever signed in that time.

    More nformation would be useful, i.e. is she being taken to court for credit card debt ? And this is the reason she is involving your fiancé?

    The Propery Settlement Agreement that accompanies most divorces should have settled that matter. In it certain debts and assets were awarded to each spouse. If they lived in a Community Property state, those debts incurred by the Community during the marriage, are Community Debts regardless of whose name was on the credit card. The creditors can go after whoever they think they can collect from. Find out if it is a CP state.

    Are you sure this is the only debt involved?

    I didn't find out exactly how much debt from his former two marriages my husband was carrying until after we were married, because his father had refinanced all of it in his name and then came to us and asked for money.

    Please make sure you know all the financial facts before you marry this man!
