    My daughter had a baby out of wedlock, she gave him her last name. The father wants to change the baby's last name to his. Can he force my daughter to change the ame? He is not seeking custody.

    No, he cannot force your daughter to make the last name change. Now he can go to court over it and plead his case there. Snce he is not wanting custody, I don't see where going to court would benefit him. Changing the last name on the birth certificate is not as easy as just going to the Department of Vital Statistics and revising the certificate. The baby's father needs to, if he is really serious about this, contact an attorney and follow your state's laws regarding this.

    To effect a change in the child's name he would have to go to court and petition for at least joint custody of the child.

    NO he cant!!
    That is your daughter's right she is the only one with rights they aren't married so that's in her favor. I gave my son my last name his dad was upset and he wouldn't sign the birth certificate oh well be mad get glad the judge won't make her change the baby's last name
