    Consentual sex
    5 yrs ago someone was convicted for having sex with a minor and sentenced to 10 yrs probation. She was 16, and it was consentual. This is in NYS. What are his chances of getting off probation early? He is a level 1 registerd sex offender in NYS (lowest level).

    Opinion, sex offenders are disliked more today than 5 years ago.
    I doubt they will even consider it.

    You can hire an attorney, talk to the probatoin officer, but this is one of those crimes that does not look good to the public, no matter if it was consentual, it is sexual contact with a minor.

    Whether the sex was consensual or not has NOTHING to do with his getting off probation early. As a matter of fact, if he brings it up as a reason, he'll probably blow any chance he might have.

    What will help him is contrition, and meeting the outlined criteria - not excuses. Hopefully you DO understand the difference.

    You ask what his chances are. If he meets the criteria, they're pretty good. If he doesn't they're pretty bad.

    Ask the probation department for its written policy and procedures manual. In it, you'll find a chapter on early termination. Follow it.

    Ok, I was in the same boat. I'm not sure of NY law but in PA as long as you are following all your parole orders and you have all your fines paid off and your parole officer don't have a problem with you getting off early then you should be able to get off early. Most places you have to have at least half your time in. If your friend is in counseling make sure to include his opinion when you petition the court.
