    Giving up parental rights
    My son has a 7 yr old child with a woman he was not married to. She was pregnant by my son when she got married to another man. Testing proved the child belonged to my son. But, the mother insisted on giving the child the surname of her husband. She has never allowed visititation to my son. In fact, my son has only seen the child once when the child was 2 1/2 yrs old when the mother drove from her town to our town to ask that my son give up parental rights, stated that she did not want the child to know my son was her father since the child had only known one father and that she did not want child support from my son. Years later, when her husband went to prison, she went to court to get child support from my son but still will not let my son see the child. So, my son wants to give up parental rights, but also wants to not be obligated financially since he has only been allowed to see the child once and cannot get custody, nor even let the child know he is her father. Any help would be appreciated as to how to formally go about doing this. Thank you.

    There are many threads that discuss this issue. Your son can relinquish his parental rights, but NOT his parental responibility.

    However, there is an interesting kicker here. You state that when the child was 2 1/2 the mother asked your son to relinquish his rights, I assume in favor of the her husband? What happened with that? Did the husband officially adopt the child?

    I think your son needs to consult an attorney who knows family law. IF your son did relinquish his rights in favor of the husband, then he should NOT have been liable for child support. What happened when she took him to court? Did you son get an attorney? Did he ask the court for visitation?

    As you can see there are a number of questions generating from the story you told us.
