I am at the breaking point of frustration with my Landlord. He recently bought my building over a month ago. The previous owner sold the property and from my understanding did not disclose all problems with the unit to the current owner. He is now in the position of frustrated tenants and has yet to fix anything!

I have been at my current location over 2 years. The apt leaks water when it rains in the kitchen and the parameter of the house. The previous landlord had been aware and made minor repairs. Approx 2 years ago they dug up the yard putting a new drainage system in, it doesn't work. Then last summer the landlord had my carpets cleaned due to mildew and replaced part of the wall that had mildew damage in the living room. The leaking has continued and he failed to make the repairs. I let it go thinking he would make the repairs. It never happened. I sent him a letter in feb when I renewed my lease about the things that needed fixed, and it never was. I called and received excused that they fired the maintenance man, etc. The new owner bought a money pit! I gave him a tour of my apt and he has saw the damage. He made wonderful promises that he would get it taken care of, to date nothing. I spoke to him today and he sounded surprised when I told him there is mold in my house, but I showed it to him before. I am past my breaking point now. It just so happened to rain today, and a lake was in my kitchen. I did take pictures of the water in the house and all the mold. After I did I had tightness in my chest, that made me realize this is nothing to let go any longer. He is coming tomorrow to look at it, but I plan to call the DEP and the local DJ on Monday, as I don't trust he will get anything done.

I am hoping to have someone test the air quality and mold in my apt, and I'm not sure who is responsible for the costs? I am also looking into seeing if I can legally break my lease due to owners being aware, and not fixing anything.

On top of all this my son has been having allergy problems and he is allergic to molds, tested positive for outdoor molds, but I'm sure the indoor molds are not healthy for anyone.

Is there anywhere else I can go for help?? I am desperate! I don't have the money to move, but either hope to get some type of assistance or borrow money. I have to do something for my children and myself, as the owners obviously do not care! :mad:

Hello sick:

In order to DO anything about your situation, you need to have documentation. Therefore, from now on, do ALL your communications with them in writing, sent certified, return receipt requested.

Doing that ALONE, will put them on notice that you're serious, and not going to take it anymore. It might get them going. If not, at least you've started the paper trail you'll need for court.

excon is right - document, document, document. Videos and pictures are helpful too. Keep track of every conversation and promise. If you need to go to court over this, you have the burden of proof. Good luck.

Update... My landlord came over on Saturday. I showed him the pics and video I took on Friday night. I also had him sign and date a statement acknowledging that he saw the water damage and mold. He once again said he would get it taken care of. That was Saturday, it is now Tuesday and no word from him. I plan to call him tomorrow to see when they are coming to fix it. ( I know it's not on his 'to do' list)

Hopefully it gets fixed, or I will just take him to court and hopefully break my lease successfully.
