    How do I get my roommate out?
    I moved in with a person I briefly met. We share a house I am renting the top floor she is renting the bottom floor. I put in the lease when we signed that she could not smoke or have friends over that smoke due to my daughters asthma. We signed a two year lease and we have lived here only 1 month she is smoking in the house, my daughter spend the weekend in the hospital. She has disabled the furnace now that I am home so I can use it when she is not home. She threatens to not pay anything however she is current at this time? Is there anything I can do to have her removed quickly for my daughters health?

    Hello maciva:

    Evict her. You're her landlord. She's violating the lease. Do it.

    If you don't know WHAT to do, at the top of this forum is a sticky note with all the states landlord/tenant laws. Go find yours, and follow it.

    I'm not as clear here as excon about your relationship. Do you own the house or are you renting it from someone else? Did the person renting the downstairs sign a lease with you or did you both sign a joint lease with the actual owner of the property?

    Please clarify how this arrangement was made so we can give you the best advice.
