    Bank Getting Judgment?
    There's an old debt in my name that the bank has begun pursuing again after 4 years, probably because they're aware of a small inheritance coming from a different acct in the same bank. The payment of the inheritance is being delayed for reason after reason. I'm concerned they're trying to get a Judgment against me. How do they do this? How long does it take? Will I have an opportunity to dispute it?

    I'm permanently disabled and earned $6,000 last year in social security. That's it. The inheritance is slightly more than that (really small). The loan was an unsecured credit card

    To get a judgement they merely file a law suit against you in civil court, you will be served notice. You will have a right to appear and prove you don't owe the debt.

    Fr. Chuck - won't that cost them a lot more in time and trouble than they'll get? I'm not disputing that the original balance is my responsibility, even though it's not my actual debt, but the $20,000 in interest they've added is out of the question.
    Without income or assets - just this little inheritance coming in - what could they expect?

    No because you get charged with all of the legal fees and court costs.
    But the cost of a judgement is very little, a legal filing and a couple hours of court time and once they have that judgement and remember that judgement stays good for 10 years, most likely a bank already has an attorney on staff, so no actually real money spent on an attorney, so they spend a couple hundred on a court filing, and they get the?? Thousand dollars, getting 5 or 6 thousand would be wroth a few hundred actually dollars spent to file ( assuming they have an attorney working for the bank)

    ** sorry if I sounded sort of cold, I am just looking from the legal aspect, not the point that you are making nothing and need the money, I truly understand.
