    Parental rights I need answer desperatley
    I have a 9 mo old baby girl. I have been with the father for about almost 2 years now. We have been having many problems in our personal relationship and we had try to work it out but its not working. He always have excuse to get away from me, I think he does not love me anymore and he want to keep me around out of conveniance so we can help each other raise the baby and pay bills. I am very unhappy around him lately long story short We both want out of the relationship. He has mentioned something about giving his parental rights to me because I am not originally from here and I would like to go back to where I am happy in Europe around my family and the baby will be happy too because she will have her own home and if I stay here I would have to live alone and struggle pay check to pay check and live in rental small apartments. Same thing is with him he does make just a bit more money than I do. So if we don't live together we can have a better life for her. Well he was very angry at first and he said that he would not let me take her back with me even if he have to pay child support. After he had calm down we had another talk and I would love if he is involved in her life but I want to go where it will be better lifestyle for her and for me as well. He realized that it will be better for her to... I am afraid that he will back up of that decision because backing up from decision is part of his personality. So... my questions are: What do we need to do for him to give up his rights? Is there some kind of legal documents for volaunterely giving up rights?What's the procedure? We don't know how to type it so I would love to see an example for one.
    And lets say he backs up... if we go to court would I be able to live the country with her if he still have rights? Do we need some kind of a document with his premision for her to leave with me?
    If he wants to fight me for rights what should I do? He has a felony and he had done domestic violence and I have reported it as well. He had been treated me bad but at the same time he seems to be a good dad but it will not be good for the baby if we stay together I don't want her to see us fighting.

    Thank you to everyone who will help me with advice. I am desperate for help. I love him very much regadrless of what person he is but he does not love me back and we basically live like room mates.:(

    You need to get an attorney to draw up formal custody and visitation arrangements and file them with the court, and they must contain language to allow you to leave the country. Without court orders and his express permission you may not be able to take her on an International flight even for a visit, let alone permanently.

    You also need to check with your home country to find out their requirements for bringing her there... is she a US Citizen, dual citizen? Does she have a passport? Will you need any immigration paperwork?

    Do not leave something this important up to verbal agreements and informal arrangements. Get an attorney.
