Credit card debt payment
My old providan visa has been sold to a collection agency. I have been working with the collector and am willing to pay $100.00 a month towards my debt of 1,400 - however, the agency wants me to mail them 3 post dated checks by Monday and then states that I will need to settle in August for the remaining balance. I asked to use the check by phone system and the collector wanted me to mail the checks instead. I am planing to send only 1check for $100 and a letter stating that I intend to make montly payments of $100 to pay off this debt. I am also writing to let them know that I do not want to be contacted by phone only by mail if necessary. My question is... can they still take me to court or pursue further action even if I make these payments? I'm thinking that because I am not willing to do what they want with these post dated checks, that they will never leave me alone.

Your right, they won't ever leave you alone. You posted a similar question yesterday. They want the full payment immediately so they can close their file. The shouldn't take you to court if you make regular monthly payments but they can threaten to all they want.
Make your payments and don't miss one. If they do take you to court they would look pretty bad and hopefully with a history of on time payments the judge will never allow it to go before the court, if he does bring proof of all your payments.

I am no expert by any means but I once had a problem with debt management and we sent out "cease and dissmiss" letters. I am sure you can do something similar, but make sure they know you want to pay...

Any special deals made are to be in writing first... do not send post dated checks or give them access to your bank accounts... they will take advantage of you if you do.
