    No insurance but I am the victim
    I was in a car accident and I found out that I had no insurance at that time. It is clearly the other drivers fault even in the police report. I need to know how can I get the company to pay for my losses?

    Hello warren:

    Well, since it wasn't your fault, it wouldn't be your insurance company that would have to pay anyway, so it's not going to matter that you didn't have insurance. What you need to do is make a claim on the other drivers insurance. I'm sure they have a phone number. Call them up.

    If the other company won't accept, you only option is to go to small claims court. I'm not sure what your states laws are, in California if you don't have insurance, you will only be entitled to vehicle damages and specials damages. Which means if you are injured, you will not be entitled to pain and suffering.

    If you have not made a claim with the other company, make sure you do so, if they deny, you will have to file in court.
