choke us and kill us for being loud?
What an absurd lie. I don't know that Penny handled it all correctly, but the man died because he was on a drug-fueled binge of threatening to kill people on a crowded subway.

The constant narrative has been the lie that it was a "choke hold"

Daniel Penny found not guilty in chokehold death of Jordan Neely
NYC subway chokehold death: Daniel Penny acquitted | AP News
Daniel Penny found not guilty in subway chokehold case

Again the compliant press trying to control the narrative.

It was not a "chokehold" ;his hand and arms never cut off Neely's breathing . He used a carotid hold or vascular neck restraint

It aint over for Penny. Now that he is criminally cleared ,he faces a civil lawsuit. In a way he's lucky . Had Clueless Joe won he no doubt would've faced Federal Civil Rights or hate crime prosecution.

Neely’s father, Andre Zachery, filed a civil suit against Penny saying his son’s death “was caused by the reason of negligence, carelessness and recklessness” .

He doesn’t request specific damages, but wants a sum that “a jury may find reasonable, fair, and just.”

    From Google AI

In the lawsuit regarding Jordan Neely's death, his father, Andre Zachery, is alleging that Neely's death was caused by "negligence, carelessness, and recklessness" on the part of Daniel Penny, the man who restrained Neely in a chokehold on the subway, essentially claiming that Penny's actions directly led to Neely's death due to his lack of care and reckless behavior. [1, 2, 3]

Key points about the lawsuit: [1, 3, 4]

    • Claim of negligence: The lawsuit argues that Penny acted negligently by using excessive force and continuing to restrain Neely even after he became unresponsive. [1, 3, 4]
    • Accusations of recklessness: The family is claiming that Penny's actions were reckless, meaning he disregarded potential risks and acted without appropriate caution when applying the chokehold. [1, 3, 4]
    • Civil nature of the suit: While Penny was acquitted of criminal charges in the case, the civil lawsuit allows Neely's family to seek compensation for damages related to his death. [1, 2, 3]

Much of the case will depend on sympathy for Neely and his unfortunate life. His mother was murdered when he was 14 ;he was homeless as the father who is making the suit was not much a part of his life.
